Governing Documents

The declaration of covenants and its amendments are public records in Miami-Dade County's official records. Board rules usually aren't recorded, so you get those from the association or the seller.

1. Search the county records. Search by the association's legal name, or the developer's or subdivision's name. Collect every amendment, not just the original declaration.

2. Check the county's association registry. Miami-Dade County requires every condo, co-op and homeowners' association to file its governing documents, including the rules, plus its budget and financial statements, with the county each year.

3. Check Sunbiz for the association's exact legal name and its filed articles of incorporation.

4. Buying here? The seller must give you a disclosure summary before you sign the contract. If you didn't get it, you can cancel within 3 days of receiving it, or before closing.
5. Already an owner? Ask the association in writing. It has 10 business days to make its official records available.
