Terms of Service

What this site is, what it is not, and the rules for using it.

Last updated

These terms govern your use of hoaguideflorida.com ("HOA Guide Florida", "we", "us"), a site published by EpicMinds LLC. By using the site you accept them. If you do not, please stop using the site.

1. What this site is

HOA Guide Florida is a free, statewide directory of Florida homeowner associations and a library of research guides about how Florida community association law, fees, and governance work. It is an information service. There is nothing to buy, no account to hold, and no service performed on your behalf.

This is the most important term on the page, so it is not buried at the bottom.

HOA Guide Florida is not a law firm and does not provide legal advice. Nothing on this site — no guide, no statutory summary, no template, and no reply we send you — creates an attorney-client relationship or substitutes for advice from a licensed Florida attorney about your situation.

Florida community association law is set by Chapter 720 (homeowner associations) and Chapter 718 (condominiums), and the legislature has amended them in nearly every recent session. On top of that, your association's own recorded declaration, bylaws, and rules control, and they differ from community to community. A guide that is accurate in general can still be the wrong answer for your association. Where a decision carries real consequences — a fine, a lien, a foreclosure, a board removal, a dispute headed to mediation — talk to a Florida community association attorney.

3. Accuracy, and the limits of it

Guides that cite statute carry a "verified" date, and we check them against primary sources before publishing. That date tells you when the check happened — not that the law is unchanged since. Confirm current statutory text at flsenate.gov before relying on it for anything that matters.

Directory listings are compiled from public records, Florida DBPR licensing data, mapping and listing sources, and submissions from boards and residents, as described on our about page. Communities change: boards turn over, management companies are replaced, amenities are added, associations dissolve. Listings may be incomplete or out of date, and we make no guarantee that any particular entry is current. If you find something wrong, tell us — corrections are the main reason the contact form exists.

We are not affiliated with, endorsed by, or acting for any homeowner association, management company, or government agency. Listing a community does not mean the association has any relationship with us.

4. The free templates

Some guides offer downloadable documents — a board code of conduct, meeting minutes, and similar. These are starting points, not finished instruments.

  • Each template is general information, not legal advice, and downloading or using one creates no attorney-client relationship.
  • Where a template says it has not been reviewed by an attorney for your association, take that literally. Have counsel review it before your board adopts it as policy.
  • Your association's governing documents override anything a template says. Where they conflict, the documents win.
  • You may use, adapt, and share a template for the governance of a community association, including within your own board and membership, at no charge. You may not resell it, package it into a paid product, or redistribute it as your own work.

5. Acceptable use

You agree not to:

  • Scrape, crawl at abusive rates, or bulk-extract the directory, the search index, or the guides in order to republish or resell the data;
  • Use anything on this site to compile or infer information about individual residents, or for any harassment, stalking, or unlawful discrimination;
  • Submit false, misleading, or impersonating information through our forms, or submit content you do not have the right to send;
  • Attempt to breach, overload, or interfere with the site, its API, or its rate limits, or to access anything not intentionally made public;
  • Use the contact form or newsletter to send spam or unsolicited commercial messages.

Ordinary reading, linking, quoting with attribution, and printing pages for your own board or household are all fine and always have been.

6. Content and intellectual property

The guides, page design, code, and compiled directory are © EpicMinds LLC, except for material we have identified as coming from elsewhere. Florida statutes are public and quoting them is unrestricted; our commentary on them is not.

You may quote reasonable excerpts with a link back. Republishing whole guides, mirroring the site, or presenting our material as your own requires written permission.

If you send us a correction, submission, or listing update, you give us permission to publish and edit it as part of the directory. Do not send us anything confidential — see our privacy policy.

7. Newsletter and downloads

Subscribing or downloading a template requires an email address, which we use only to send what you asked for and related Florida HOA updates. Every message carries an unsubscribe link and you can leave at any time. What we store and how to have it deleted is set out in the privacy policy.

8. Advertising and paid placements

The site may carry advertising or paid listings, and we may earn from partnerships described on our partners page. Paid placements are identified as such. Payment never buys a favourable statement of law in a guide, and it does not change how a community's factual listing is presented.

9. Third-party sites

We link to statutes, agencies, associations, and other resources. We do not control them and are not responsible for their content, accuracy, or privacy practices. A link is not an endorsement.

10. Disclaimer of warranties

The site and everything on it are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that any listing, guide, or template is accurate, current, or suitable for your association.

11. Limitation of liability

To the fullest extent permitted by Florida law, EpicMinds LLC and its officers, members, employees, and contributors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any lost profits, lost data, fines, assessments, liens, or legal costs, arising out of your use of — or reliance on — this site, even if we have been advised such damages are possible. Where liability cannot be excluded, our total aggregate liability to you for all claims is limited to one hundred US dollars ($100).

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify and hold harmless EpicMinds LLC from claims, damages, and reasonable legal costs arising out of your misuse of the site, your breach of these terms, or content you submit to us.

13. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from them or from your use of the site will be brought in the state or federal courts located in Florida, and you consent to that venue.

14. General

If any provision of these terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the privacy policy, are the entire agreement between us regarding the site.

15. Changes

We may update these terms. The date at the top of the page shows when they last changed, and continued use of the site after a change means you accept the updated terms.

16. Contact

Questions about these terms go through the contact form. HOA Guide Florida is operated by EpicMinds LLC, Florida, United States.

These terms govern this website. They say nothing about the obligations your association owes you, or you owe it — those come from Chapter 720, Chapter 718, and your recorded governing documents. Start with Florida HOA laws explained.
